1. Introduction (a) This Privacy Policy sets out how MATESHIP AU PTY LTD (ABN 62 659 933 445) (Mateship) manages personal information, including in relation to our website located at www.mateship.app (our Website) and mobile application (App), other related websites, mobile applications, via email, cloud-based services, or controlled widgets embedded in communication platforms with a link to this Privacy Policy (together, Website/App). (b) In this Privacy Policy, personal information means any information or opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not and whether recorded in a material form or not. Any terms not defined in the Privacy Policy are defined in the Terms of Service. (c) Mateship complies with the Privacy Act 1988 (Cth) (Privacy Act), the applicable Australian Privacy Principles under that Act and any other applicable privacy laws when handling personal information. We take the protection of your personal information seriously.
2. Consent (a) By providing personal information to us, you consent to us collecting, holding, using and disclosing your personal information in accordance with and for the purposes specified in this Privacy Policy. (b) You are not required to provide personal information to us. However, if you do not provide us with all the information we request, the services we provide to you may be affected.
3. Collection (a) The types of personal information we collect and hold may include: (i) your name; (ii) gender; (iii) date of birth; (iv) home address and any other postal addresses; (v) workplace; (vi) telephone number; (vii) email address; (viii) profile picture; (ix) payment method and payment account; (x) additional verification data, including government identification; (xi) information related to invited members and social networks; (xii) social network account and profile data (including in circumstances when you have used a social login); (xiii) location information including general location information from your computer or mobile device or precise GPS location information from your mobile device; (xiv) records of your communication and interaction with us; (xv) information and history about your purchases, deliveries, other preferences, interests and behaviour relating to transactions, products, and services, on and using the Mateship Website and App. (xvi) your personal preferences; (xvii) information (such as whether you have received the goods, and type of merchant) about the interaction between you and merchants including your dealings with merchants you visit or shop with; and (xviii) information related to grouped deliveries, participants in the grouped delivery and interactions between participants in the grouped delivery. (b) We also collect information which does not allow us to identify you specifically, including: (i) your device’s IP address; (ii) your device type; (iii) browser type; (iv) details of the site from where you accessed the Mateship Website or App; (v) referring and exit pages and URLs; (vi) the pages you visit on the Mateship Website or App; and (vii) the time spent on those pages, items, and information searched, access times, dates and other statistics. (c) We may collect personal information from you or about you in other ways such as through contact with our customer support team, suppliers or service providers (whether via mail, web chat, chat bot, email or through telephone enquiries), your responses to a market survey, and from interactions with our Partners or as otherwise notified to you at the time. (d) We may also collect personal information about you from third parties including our Partners, related companies, identity verification services, and publicly or commercially available sources. (e) You may choose to provide us with access to certain personal information stored by third parties such as social media sites (e.g. Facebook and Twitter). The information we may receive varies by site and is controlled by that site. By associating an account managed by a third party with your Mateship account and authorising Mateship to have access to this information, you agree that Mateship may collect, store and use this information in accordance with this Privacy Policy. (f) We may also collect the Personal Information of our Partners’ staff and subcontractors during the course of our business activities. This information may include your name, contact details and position. We will collect this information directly from you, or from the applicable Partner. (g) We also collect information using “cookies” on our Website for the purposes of operating an efficient online service and tracking the patterns of behaviour of visitors to the Website. Although you can usually modify your browser to prevent cookie use, if you do this, our Website may not work properly for you. (h) We sometimes work with Partners and online advertising vendors to provide you with relevant and useful advertisements. This may include advertisements served on or through our Website and App. This may also include advertisements served on other companies’ websites. These advertisements may be based on information collected by us or third parties. For example, your postal code may be used to target an advertisement for people in your area. These advertisements may also be based on your activities on our Website, App or on third party websites. 4. Purpose (a) We collect and hold personal information for the purpose of: (i) providing, testing and improving the products and services you have requested and developing new products and services; (ii) notifying you about changes to the products and services you have requested; (iii) providing recommendations and purchase history to other users of the Website/App; (iv) to contact you about our products and services and the products and services of Partners; (v) providing customer support, including addressing questions and problems that users encounter; (vi) to produce and provide insights, trends, and other relevant information about you; (vii) detecting, preventing and addressing technical or other issues; (viii) generally carrying out our business; (ix) setting up and managing accounts, including identification and authentication; (x) collecting or making a payment; (xi) processing or supporting fulfilment of orders; (xii) finding or recommending a local feature/service, such as a pickup location; (xiii) communicating with you, using email, SMS, push notifications or platform messaging about your account or to market product listings, features, campaigns or events; (xiv) preventing, detecting, investigating and responding to fraud, unauthorised access/use of the Services, breaches of terms and policies, or other wrongful behaviour; (xv) analyse use of the products and services and personalise content, including advertisements, campaigns, products, merchants and prices; (xvi) complying with laws or regulations; and (xvii) promoting and marketing products, services and special offers that may be of interest to you. (b) We may also use personal information for related purposes that would be reasonably expected by you.
5. Use and disclosure (a) We will not use or disclose your personal information for any purpose other than the purpose for which it was collected (or a related purpose) unless you have consented to that other purpose or we are permitted to do so by law. (b) We may disclose your personal information to: (i) our affiliates and related companies; (ii) our Partners, and the suppliers and service providers who help with our business operations including in relation to fraud prevention, identity verification, administrative functions, payments, marketing, customer service, technology services, and other related functions on our behalf; (iii) our retailers and third-party suppliers, so that they can provide goods or services to you (or the recipient of third-party goods or services) or respond to a complaint by you, or to help them improve the quality and standard of service they provide to you. If you transact with a retailer in another country, we will disclose personal information to such locations; (iv) Companies that we plan to merge with or be acquired by or who may invest in us; (v) Law enforcement, government agencies or officials, or third parties pursuant to a subpoena, court order, or other legal process or requirement applicable to Mateship in situations where we need to do so to comply with the law, or when we believe, in our sole discretion, that the disclosure of Personal Information is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate suspected violations of any policies or agreements we have in place; and (vi) Other third parties with your consent or direction to do so. (c) The recipient of your personal information, including our Partners, to whom we disclose your personal information may be located outside of Australia. It is not practicable to identify the countries in which the recipients are likely to be located. Please note that these third parties may be in other countries where the laws on processing personal information may be less stringent than in your jurisdiction. In addition, you should note that retailers and third-party suppliers that you buy goods or services from or contract with (even if such goods or services are purchased through Mateship), have their own privacy policies, and Mateship is not responsible for their actions, including their information protection practices. (d) If you open a Mateship account directly on a third-party website or via a third-party application, any information that you enter on that website or application (and not directly on Mateship’s Website/App) will be shared with the owner of the third-party website or application. These sites are governed by their own privacy policies and you are encouraged to review their privacy policies before providing them with personal information. Mateship is not responsible for the content or information practices of such third parties. (e) In all cases, unless you have opted out, you consent to us using your personal information for direct marketing purposes in order to tell you about services and offers that we think may be of interest to you. We may contact you by mail, telephone, email or SMS to market our services. We will always give you the opportunity to opt out of receiving any future direct marketing correspondence.
6. Integrity of personal information (a) We will take such steps (if any) as are reasonable in the circumstances to ensure that the personal information we collect is accurate, up-to-date, and complete, and that the personal information we use and disclose is accurate, up-to-date, complete and relevant (having regard to the purpose of the use or disclosure). To assist us, please ensure that the information you provide to us is accurate, up-to-date, and complete. (b) We will also take such steps (if any) as are reasonable in the circumstances to protect the personal information we collect and hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. (c) If we hold personal information about you that is no longer needed for any purpose for which it may be used or disclosed, we will take such steps as are reasonable in the circumstances to destroy or permanently de-identify that personal information.
7. Access to and correction of personal information (a) You can request, and we will provide you with access to, any personal information we hold about you (subject to certain legal exceptions). If a legal exception applies and we decide not to provide you with access to any personal information we hold about you, we will advise you of the reasons for our decision. (b) If we are satisfied that any personal information we hold about you is inaccurate, incomplete, out of date, misleading or irrelevant (having regard to the purpose for which it is held) we will take such steps (if any) as are reasonable in the circumstances to correct that personal information. If we do not agree that personal information we hold about you is inaccurate, incomplete, out of date, misleading or not relevant you may ask that we attach a statement to this effect to your record. The OAIC has the power to investigate the matter and make a determination.
8. Other organisations’ websites (a) The Website and our email communications may contain links to other websites. We do not control these websites or any of their content and if you visit these websites, they will be governed by their own terms of use (including privacy policies). (b) Additionally, our Partners are responsible for their own privacy policies and privacy practices. Please contact our Partners directly for further information on their privacy policies.
9. Changes to this Privacy Policy We may, from time to time, amend this Privacy Policy, in whole or part, in our sole discretion. Any changes to this Privacy Policy will be effective immediately upon the posting of the revised Privacy Policy on the Website and App. Depending on the nature of the change, we may announce the change on the home page of the Website or by email (if we have your email address). However, in any event, by continuing to access our services following any changes, you will be deemed to have agreed to such changes. If you do not agree with the terms of this Privacy Policy, as amended from time to time, in whole or part, you must not access our services including the Website and App.
